KJD Digital, LLC. (“TACTTIX,” “we,” “us,” “our”) provides an event management platform (the “Service”) to event hosts (our “Clients”) to help them manage events, sell tickets, and manage liability waivers.
This Privacy Policy describes how we collect, use, and share information. It is crucial to understand that our data-handling practices differ depending on whether you are a Client (an event host using our platform) or an End-User (an attendee or customer of our Client).
- Clients: Business entities (e.g., action sports fields) who sign up for a TACTTIX account.
- End-Users: Individuals who buy tickets, sign waivers, or interact with a Client’s event through our Service.
By using the Service, you agree to the collection, use, and sharing of your information as described in this policy.
2. Our Role: Data Controller vs. Data Processor
This distinction is important for understanding your rights.
- For Clients: When you sign up for a TACTTIX account and provide your business information, payment details, and contact info, we are the “Data Controller” of that information.
- For End-Users: When you buy a ticket, sign a waiver, or provide your personal information for an event, our Client (the event host) is the “Data Controller.” TACTTIX is acting as a “Data Processor” on their behalf. This means we only process your data as instructed by the Client.
If you are an End-User with a privacy request (e.g., to delete your data), you must contact the event host (our Client) directly.
3. Information We Collect
A. Information We Collect from Clients
When you (a Client) create an account, we collect:
- Account Information: Your name, email address, phone number, and password.
- Business Information: Your company name, subdomain preference, and location data.
- Billing Information: Payment details, billing address, and transaction history. (Note: We use a third-party payment processor, like Square, to handle this. We do not store your full credit card number).
B. Information We Process on Behalf of Clients (from End-Users)
When you (an End-User) use the Service to interact with a Client’s event, we process:
- Contact Information: Your first name, last name, email address, and phone number.
- Waiver Information: Date of birth, address, and, if applicable, the name and date of birth of any minors you are a guardian for.
- Signature Data: Your digital signature image and the date/time of the signature.
- Order Information: The types of tickets and add-ons you purchase and their total cost.
- Payment Information: Your payment card details, which are provided directly to a third-party payment processor and are not stored in our system.
C. Information We Collect Automatically (from all users)
- Cookies & Log Files: Like most websites, we use cookies and server logs to collect information like your IP address, browser type, operating system, and pages visited. This helps us secure and improve the Service.
4. How We Use Information
A. How We Use Client Information
We use your information as a Data Controller to:
- Provide, maintain, and improve the Service.
- Process your subscription payments.
- Communicate with you about your account, support requests, and service updates.
- Send you marketing communications (which you can opt out of).
B. How We Use End-User Information
We use your information as a Data Processor to:
- Fulfill our contractual obligation to our Client (the event host).
- Process your ticket order and payment.
- Facilitate the signing, storing, and management of your digital liability waiver.
- Provide the Client with the data needed to check you in at their event.
- Send you confirmation emails (for tickets, group management, or waivers) on behalf of the Client.
5. How We Share Information
We do not sell your personal information or the personal information of End-Users.
We may share information in the following ways:
- With Our Clients: We provide End-User information to the specific Client whose event you are interacting with. This is the primary purpose of the Service.
- With Service Providers: We use third-party companies to help us operate (e.g., payment processors like Square, cloud hosting like Digital Ocean, and email delivery services like MailGun). They are given access only to the information needed to perform their service and are bound by confidentiality.
- For Legal Reasons: We may disclose information if required by law, subpoena, or to protect the safety and rights of our users or the public.
- Business Transfers: If KJD Digital, LLC. or TACTTIX is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that deal.
6. Data Security
We implement commercially reasonable technical and administrative security measures to protect the information we handle. However, no system is 100% secure. We cannot guarantee the absolute security of your information.
7. Data Retention
- Client Information: We retain your account information as long as your account is active and for a reasonable period after for billing, legal, and archival purposes.
- End-User Information: We retain your information for as long as our Client’s account is active, as we are processing it on their behalf. When a Client deactivates their account, we may delete the associated End-User data after a certain period, in accordance with our data retention policies.
8. Your Data Rights & Choices
A. For Clients
- You can access and update your account information by logging into your admin dashboard.
- You can opt out of marketing emails by clicking the “unsubscribe” link.
- You can request to delete your account by contacting us.
B. For End-Users
- As TACTTIX is the Data Processor, you must contact the Client (the event host) directly to exercise your data rights (e.g., to access, correct, or delete your information).
- TACTTIX will assist our Clients in responding to these requests.
- You may be able to opt out of email communications from the Client, typically via an “unsubscribe” link in the email.
9. Children’s Privacy
Our Service is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13 for our own purposes.
Our Service is designed to allow Clients to collect waiver information for minors, which is required to be provided by a legal guardian. This information (e.g., a minor’s name and DOB) is provided with the guardian’s explicit consent and is processed by TACTTIX only on behalf of the Client.
10. Changes to This Privacy Policy
We may update this policy from time to time. If we make material changes, we will notify you by emailing our Clients or by posting a notice within the Service before the changes take effect.
